FAB Homes LLC and its affiliated single-purpose entities ("FAB Homes," "we," "our," or "us") respect your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard personal information when you visit fabhomesus.com (the "Site") or otherwise engage with us. It also describes the rights of California residents, residents of Brazil, and other jurisdictions with applicable data protection laws.

By using the Site, you acknowledge that you have read and understood this Privacy Policy.

1. Important Notice Regarding Investment Information

Nothing on the Site constitutes an offer to sell or a solicitation of an offer to buy any security. Any information regarding FAB Homes investment opportunities is made available only to prospective investors with whom FAB Homes has a pre-existing substantive relationship, who have established their status as "accredited investors" within the meaning of Rule 501(a) of Regulation D under the Securities Act of 1933, and only pursuant to definitive offering documents delivered separately. Submission of a contact form does not establish such a relationship.

2. Information We Collect

We collect the following categories of personal information, in each case for the business purposes described in Section 3:

(a) Information You Provide Directly:

  • Identifiers: name, email address, mailing address, telephone number.

  • Professional or employment information: employer, title, accreditation status (when voluntarily provided in investor inquiries).

  • Commercial information: properties or services of interest.

  • Communications: the contents of messages, inquiries, and any other information you choose to provide.

(b) Information Collected Automatically:

  • Internet activity information: IP address, browser type, operating system, device identifiers, referring URLs, pages visited, time and date of visits, and clickstream data.

  • Geolocation data: approximate location derived from IP address.

  • Cookies and similar technologies (see Section 5).

(c) Sensitive Personal Information. We do not knowingly collect "sensitive personal information" as defined under the California Privacy Rights Act (CPRA), Brazil's Lei Geral de Proteção de Dados (LGPD), or comparable laws. If you voluntarily provide such information (e.g., financial account details in an investor questionnaire), we will treat it with heightened safeguards and only use it for the purpose for which it was provided.

(d) Sources. We collect information directly from you, automatically through your interaction with the Site, and from third-party service providers (e.g., analytics, CRM, marketing platforms) and publicly available sources.

3. How We Use Your Information

We use the information we collect for the following business and commercial purposes:

  • To operate, maintain, and improve the Site;

  • To respond to your inquiries and to schedule meetings;

  • To communicate with prospective investors with whom we have a pre-existing substantive relationship regarding offerings made under applicable securities exemptions;

  • To send general marketing communications and newsletters that you have opted to receive (you may unsubscribe at any time);

  • To analyze Site usage and improve user experience;

  • To comply with legal obligations, including securities, anti-money laundering, "know your customer," and tax reporting requirements;

  • To detect, prevent, and address fraud, security incidents, and unlawful activity;

  • To establish, exercise, or defend legal claims.

We do not use your personal information for purposes that are materially different, unrelated, or incompatible with the purposes disclosed in this Policy without providing you notice.

4. How We Share Your Information

We do not sell or "share" (as defined under the CPRA, i.e., for cross-context behavioral advertising) your personal information. We disclose personal information only as follows:

  • Service Providers and Contractors: Vendors that perform services on our behalf under contractual confidentiality and use restrictions consistent with CCPA/CPRA §1798.140 (including, by way of example, HubSpot for CRM, Google Analytics for analytics, and email delivery platforms).

  • Professional Advisors: Attorneys, accountants, auditors, and other professional advisors.

  • Financing and Investment Counterparties: Lenders, co-investors, and capital partners, only to the extent necessary in connection with a specific transaction and subject to appropriate confidentiality obligations.

  • Legal and Regulatory: Where required by law, subpoena, court order, or other legal process, or to protect our rights, property, or safety, or that of others.

  • Corporate Transactions: In connection with a merger, financing, acquisition, reorganization, or sale of assets, subject to standard confidentiality protections.

5. Cookies and Tracking Technologies

The Site uses cookies and similar tracking technologies, including those provided by Google Analytics and HubSpot, to recognize repeat visitors, analyze traffic, and improve user experience. You may set your browser to refuse cookies or alert you when cookies are sent; however, some Site features may not function properly if cookies are disabled.

Do Not Track. Our Site does not currently respond to "Do Not Track" browser signals because no uniform industry standard has been adopted.

Global Privacy Control. California residents may exercise opt-out rights through a Global Privacy Control (GPC) signal where supported.

6. Data Retention

We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, including for purposes of satisfying any legal, accounting, regulatory, or reporting requirements (which, for investor-related records, typically extends through the life of the relevant investment vehicle plus statutory record-retention periods of up to seven years thereafter). When retention is no longer necessary, we securely delete or anonymize the information.

7. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. No method of transmission over the Internet or method of electronic storage, however, is 100% secure, and we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify you and applicable regulators as required by law.

8. International Data Transfers

FAB Homes is based in California, United States. If you access the Site or provide information to us from outside the United States — including from Brazil or the European Economic Area — your information will be transferred to, processed, and stored in the United States. By providing your information, you consent to this transfer. We use appropriate safeguards (including contractual protections with our service providers) for international transfers as required by applicable law.

For Brazilian residents: Processing is conducted in accordance with Brazil's Lei Geral de Proteção de Dados (Law No. 13.709/2018, "LGPD"). The controller is FAB Homes LLC. You may contact us at the address in Section 12 to exercise your LGPD rights, including the rights of access, correction, anonymization, portability, deletion, information regarding sharing, and revocation of consent.

9. Your Rights and Choices

9.1 California Residents (CCPA / CPRA)

If you are a California resident, you have the right to:

  • Know what categories and specific pieces of personal information we have collected, the sources, the business or commercial purposes for collection, and the categories of third parties with whom we share it.

  • Delete personal information we have collected from you, subject to statutory exceptions.

  • Correct inaccurate personal information.

  • Opt out of the sale or sharing of personal information. As stated in Section 4, FAB Homes does not sell or share personal information.

  • Limit the use of sensitive personal information to those uses permitted under the CPRA.

  • Non-discrimination for exercising your privacy rights.

  • Designate an authorized agent to make a request on your behalf, subject to verification.

To exercise any of these rights, contact us using the methods in Section 12. We will verify your identity before responding. We will respond within 45 days, with one 45-day extension where reasonably necessary.

9.2 All Users

Regardless of jurisdiction, you may:

  • Opt out of marketing emails by clicking the "unsubscribe" link in any marketing communication or by contacting us;

  • Request access to, correction of, or deletion of information you have provided.

10. Children's Privacy

The Site is not directed to children under the age of 16, and we do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us and we will take steps to delete it.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The "Last Updated" date at the top of this Policy indicates when it was last revised. Material changes will be communicated by posting a prominent notice on the Site or, where required, by direct notice. Your continued use of the Site after the effective date of any change constitutes your acceptance of the revised Policy.

13. Governing Law

This Privacy Policy is governed by the laws of the State of California, without regard to its conflict of laws principles, except where a more protective standard is required by the law of your jurisdiction of residence.
